These Terms of Service ("Terms") govern your use of The Plated Lab website and any purchases made through it (the "Store"). By accessing our website or making a purchase, you agree to be bound by these Terms.

1. Who We Are

The Store is owned and operated by The Plated Lab (“we,” “us,” or “our”).

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order through our Store. By submitting an order, you represent and warrant that you meet this requirement.

3. Products, Custom Work, and Material Variations

• Made-to-Order: Many of our items are custom-made, personalized, or manufactured to order.

• Natural Material Variations: You acknowledge that items made from natural materials (including but not limited to wood, slate, leather, and glass) possess inherent natural variations. Wood grain patterns, knots, engraving depth, texture, charring, and color finishes will vary from piece to piece. Digital mockups, design proofs, and product photos are for preview purposes only and do not guarantee an exact identical match.

• Right of Refusal: We reserve the right to refuse any custom design or personalization request that includes trademarked or copyrighted material (without proof of authorization), hate speech, harassment, or any content we deem unlawful, offensive, or unsafe.

4. Pricing and Taxes

• Prices for our products are subject to change at any time without notice.

• Applicable sales tax will be calculated and displayed dynamically at checkout based on your delivery address and state regulations.

5. Payment & Order Confirmation

We accept the payment methods displayed during the checkout process. Your order is not officially accepted or confirmed until your payment has been successfully processed and authorized by the payment gateway.

6. Order Acceptance & Cancellations

• We reserve the right to decline, limit, or cancel any order for any reason, including suspected fraud, inventory shortages, or errors in pricing and descriptions.

• Because production on custom orders often begins immediately following design approval, cancellations or modifications may not be possible once an order enters production. If you notice a mistake, contact us immediately at tpl@theplatedlab.com.

7. Customer Personalization Responsibilities

• You are solely responsible for ensuring the accuracy of all customization details provided to us (including names, dates, spelling, punctuation, capitalization, and formatting).

• We will engrave or cut the exact text and design details submitted. The Plated Lab is not responsible for errors, typos, or mistakes provided by the customer. Remakes for customer errors will be at the customer's expense.

8. Shipping, Delivery, and Local Pickup

• All shipping timelines, calculated costs, and local pickup terms are governed strictly by our Shipping Policy.

• The risk of loss and title for all physical items pass to you immediately upon our delivery of the package to the shipping carrier, or upon physical transfer of possession during a local pickup.

9. Returns and Refunds

All returns, exchanges, and refund eligibility rules are governed strictly by our Returns & Refunds Policy. You acknowledge that custom and personalized items are final sale and non-refundable unless they arrive damaged or defective.

10. Intellectual Property

All content included on this website—including text, graphics, product designs, laser cut templates, photos, logos, digital downloads, and branding—is the exclusive property of The Plated Lab or its content suppliers and is protected by United States and international copyright and trademark laws. It may not be copied, reproduced, or redistributed without our express written consent.

11. User-Submitted Content

If you submit product reviews, photos, testimonials, or public comments to us, you grant The Plated Lab a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute that content for marketing, social media, and storefront promotional operations, unless prohibited by law.

12. Prohibited Uses

You agree not to use our Store or website to:

• Violate any federal, state, or local laws or regulations.

• Infringe upon or violate our intellectual property rights or the rights of others.

• Transmit viruses, malware, or any destructive code designed to disrupt store operations.

• Scrape, crawl, or reverse-engineer the storefront or its underlying software.

13. Disclaimer of Warranties

Our website and all products and services delivered to you through the store are provided on an “as is” and “as available” basis for your use, without any warranties, representations, or conditions of any kind, either express or implied, to the fullest extent permitted by law.

14. Limitation of Liability

To the maximum extent permitted by New Jersey state law, The Plated Lab and its owners shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of our products or website storefront. Our total liability for any legal claim shall not exceed the actual purchase price paid by you for the specific product giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless The Plated Lab and its owners from any third-party claims, liabilities, damages, or costs (including legal fees) arising from your misuse of the Store, your violation of these Terms, or your infringement of any intellectual property rights (including requesting the engraving of copyrighted or trademarked logos without permission).

16. Governing Law

These Terms and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict-of-law principles. Any legal disputes must be filed in the appropriate court local to The Plated Lab.

We reserve the right to update, modify, or replace any part of these Terms of Service at our discretion. It is your responsibility to check our website periodically for changes. Your continued use of the website following the posting of any changes constitutes acceptance of those updates.
